Intestate Succession in Turkey: Understanding Asset Distribution Without a Will

Intestate succession in Turkey refers to the distribution of assets when a person dies without leaving a valid Turkish will.

Turkish inheritance laws govern this process through a strict legal hierarchy of heirs, ensuring that property and assets are passed on to family members in a predetermined order.

Inheritance law in Turkey prioritises the distribution of assets among heirs based on their relationship to the deceased. In cases of intestate succession in Turkey, the spouse and children are the primary legal heirs. If the deceased has children, the estate is divided between the children and the surviving spouse. If one of the children is deceased, their share passes to their own children (the deceased’s grandchildren) by representation. If there is no surviving spouse or children, the deceased’s parents inherit equally, with siblings next in line. Distant relatives, such as grandparents, uncles, aunts, and cousins, inherit if no immediate family exists. Lastly, if no legal heir can be found, then the estate is transferred to the Turkish Treasury (Devlet Hazinesi).

Important: With regard to understanding asset distribution in Turkey, please note that intestate succession follows a strictly determined order, disregarding the deceased’s wishes or the wishes of the surviving family. Without a Turkish will, individuals have no control over how their assets are distributed upon their passing, which is why making a will in Turkey is strongly advised to ensure assets are shared as desired and to avoid complications and family disputes.
