Property owner reviewing a tenancy agreement before renting out a home in Turkey.

Renting out property in Turkey involves more than agreeing the monthly rent. You also need to understand how the tenancy can renew, how to handle the deposit and what happens if you later need the home back.

You may have found a tenant and agreed a price. However, a standard agreement may leave important questions unanswered. Notarising it does not replace checking the terms and the legal rules that apply.

This guide focuses on ordinary long-term residential tenancies. It explains the practical points to resolve before you sign or hand over the keys.

Am I arranging a residential tenancy or a holiday let

Decide how you intend to use the property before advertising it. A tenant’s long-term home and a short holiday stay can involve different legal requirements.

Turkey’s tourism rental regime generally requires a permit for lettings of 100 days or less at a time. Do not assume that calling an arrangement a “residential tenancy” removes those requirements. Ask a lawyer to check the actual arrangement, including any repeated shorter lettings.

If you plan to switch between a long-term tenant and summer guests, discuss that plan before signing. The tenant’s rights may prevent you from using the property when you expect.

Does the tenancy agreement need notarising

An ordinary private residential tenancy does not generally need notarisation to be valid. Even so, a clear written agreement gives both sides a useful record of what they have agreed.

Notarisation can help with evidence of signatures or dates. It does not make every clause enforceable or guarantee that you can recover the property on demand.

Ask your lawyer whether notarisation serves a particular purpose in your case. If someone needs a notarised document for a separate administrative procedure, check that requirement separately. Make sure you understand the wording before signing, using a reliable translation where necessary.

How should I collect the rent

Arrange payment through a bank or PTT, the Turkish postal service, and retain the supporting records. Current Turkish tax rules require landlords and tenants to document ordinary residential rent payments through these channels, regardless of the amount.

Put the payment details in the agreement. Ask the tenant to identify the rental period and property in each payment reference. Keep rent payments separate from the security deposit in your records.

If someone proposes rent in pounds, euros or dollars, check the applicable currency rules before agreeing. Your foreign nationality alone does not settle the position for every tenancy.

How much deposit can I ask for

For ordinary residential tenancies covered by Article 342 of the Turkish Code of Obligations, the agreed security cannot exceed three months’ rent. For a money deposit, the law provides for a blocked interest-bearing savings account, rather than money you can freely spend.

Ask your lawyer and bank how to arrange the account and its release conditions. The agreement should explain what the deposit secures and how the parties will deal with any claim at the end.

Keep evidence of any damage or unpaid amounts. A deposit is not an automatic payment to the landlord when a tenancy ends, and it does not guarantee recovery of every loss.

How should I agree future rent increases

For ordinary Turkish-lira residential tenancies, agreed renewal increases generally cannot exceed the change in the consumer price index based on twelve-month averages under Article 344. The relevant published figure changes, so avoid copying a fixed percentage from an old agreement.

Ask your lawyer to check the proposed clause. A separate court-based rent determination may be available after five years, subject to the applicable conditions. That does not mean you can automatically reset the rent to any advertised market price.

Will a one-year agreement let me take the property back after one year

Do not plan on that basis. Under the ordinary residential tenancy rules, a fixed-term agreement generally renews if the tenant does not end it in the required way. The landlord cannot terminate it simply because the agreed term has expired.

For example, signing a one-year tenancy while assuming you can move back the following summer could leave you with a serious problem. Tell your lawyer about any planned return, sale or family use before you commit.

Ask what lawful grounds and procedures could apply to your circumstances. A clause saying “the tenant must leave at the end” does not, by itself, settle your right to possession.

What if I need to move back or sell

A genuine housing need may support a legal route to ending a tenancy, but conditions and deadlines apply. Explain your circumstances early rather than promising yourself a particular move-in date.

Selling the property does not automatically end the tenancy. The buyer generally takes over the landlord’s position, so discuss the existing tenancy before agreeing a sale that requires an empty property.

You may also hear about a tahliye taahhütnamesi, a written undertaking to vacate. This has separate requirements, including that the tenant gives it after the property has been delivered. Do not rely on a blank, backdated or casually prepared document. Ask your lawyer about its validity and the procedure for enforcing it.

Can I manage the tenancy while living abroad

Make a practical plan for repairs, payments and important correspondence. Decide who can authorise work, what they may spend and when they must contact you.

If someone will sign documents or act formally on your behalf, ask whether they need a power of attorney and what authority it should contain. Our guide to dealing with Turkish property from abroad explains the general approach.

Keep your contact details current and arrange prompt review of any formal notice. If a dispute arises, seek advice before taking action. Many tenancy claims require mediation before a lawsuit, although exceptions apply. Do not try to resolve a possession dispute by changing locks or cutting services.

What about tax and insurance

Ask a Turkish tax adviser about declaring rental income, available deductions and the rules for your tax residence status. Living abroad does not automatically remove Turkish tax obligations on rent from Turkish property. Check any reporting duties in your country of tax residence too.

Keep rental records and invoices from the start. Also tell your insurer how you intend to let the property and check the cover for a tenanted or furnished home.
